These terms cover using this website and ordering from Catch153. Placing an order means you accept them, so it is worth a read — particularly the parts about delivery areas and about frozen food, which work differently from an ordinary online shop.
Who we are
Catch153 sells frozen and pre-packed food and groceries online for delivery in Ontario. In these terms, “we” and “us” mean Catch153, and “you” means the person placing the order. Reach us at orders@catch153.ca.
Your account
You need an account to place an order. Keep the details you give us accurate — a wrong phone number or address is the most common reason a delivery fails — and keep your sign-in credentials to yourself. You are responsible for orders placed from your account.
We may suspend or close an account that is being used fraudulently, abusively, or in a way that puts our staff or drivers at risk.
Where we deliver
We deliver to specific service areas, matched to the first three characters of your postal code. If your postal code is not in an area we serve, we cannot accept the order — the checkout will tell you before you pay, not after.
Areas change as we grow, so a postal code we cannot reach today may be serviceable later. Delivery charges and free-delivery thresholds can differ by area, and the amounts shown at checkout are the ones that apply to your order.
Orders
Adding items to your basket and paying is an offer to buy. A contract forms when we confirm the order — not when the basket is submitted. Until then we may decline it.
We may cancel a confirmed order, and refund it in full, if:
- an item turns out to be out of stock;
- the delivery address turns out to be outside our service area;
- a price or product description was obviously wrong; or
- we suspect fraud.
Prices, tax and delivery charges
Prices are in Canadian dollars. Most groceries are zero-rated for HST, so tax may apply to only part of your basket; the tax actually charged is itemised at checkout and on your order.
Delivery is free above the threshold shown at checkout, and charged below it. Every total is calculated by us at the moment you order, and the delivery charge and threshold that applied are recorded on the order itself — so if we change our pricing later, it never rewrites what an order you already placed was charged.
Prices can change at any time before you order. Promotions run for the period stated and may be withdrawn.
Payment
Payment is taken at checkout by card, processed by Stripe. Your order is placed once payment succeeds. We never see or store your card number — see the privacy policy.
Delivery
We will let you know when your order is on its way. Delivery times are estimates, not guarantees: weather, traffic and road conditions all affect a local route.
Because this is frozen and chilled food, someone needs to be there to receive it. If nobody is available and there is no safe place to leave it, we may have to return the order, and we cannot refund goods that have thawed as a result. Delivery instructions you save on an address help us avoid this.
Frozen food, changes of mind, and refunds
For food-safety reasons we cannot accept returns of frozen, chilled or perishable food once it has been delivered, and we cannot resell it. That means there is no change-of-mind return on those items.
That does not affect your rights when something is actually wrong. If an item arrives:
- damaged, spoiled, or thawed on arrival;
- past its date; or
- missing from the order, or not what you ordered,
contact us at orders@catch153.ca within 24 hours of delivery, with a photo where the problem is visible, and we will replace it or refund it. Refunds go back to the card that paid, and usually take a few business days to appear.
You can ask us to cancel an order before it is dispatched, and we will refund it in full.
Product information and allergens
We describe products as accurately as we can, but photographs are illustrative and pack weights are approximate — a pack sold by weight will vary a little.
Always read the packaging. Ingredients, allergen information and storage instructions on the pack you receive are what count, and a manufacturer can change a recipe before we can update a listing. If you have a food allergy, do not rely on this website alone.
Store frozen items at −18 °C or colder, and get them into a freezer promptly after delivery.
Using this website
Use the site lawfully. Do not attempt to break into it, disrupt it, scrape it in bulk, or use it to place fraudulent orders. The content on the site — text, photographs, the Catch153 name and logo — belongs to us and may not be reused without permission.
Availability
We aim to keep the store running, but we do not promise it will be available uninterrupted. We may suspend it for maintenance, and we may change or withdraw products at any time.
Our responsibility to you
If we fail to meet these terms we are responsible for loss you suffer that is a foreseeable result of that failure. We are not responsible for loss that was not foreseeable, or for business losses.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or your rights under Ontario's consumer protection legislation.
Governing law
These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there, and the courts of Ontario have jurisdiction over any dispute.
Changes to these terms
We may update these terms. The version in force for your order is the one published when you placed it, and the date at the top of this page tells you when it last changed.
